Persons NOT Eligible for Burial in a VA National Cemetery


a. Former Spouses

A former spouse of an eligible individual whose marriage to that individual has been terminated by annulment or divorce, if not otherwise eligible.

b. Other Family Members

Family members of an eligible person except those defined as eligible in Section III, paragraph g.

c. Disqualifying Characters of Discharge

A person whose only separation from the Armed Forces was under dishonorable conditions or whose character of service results in a bar to Veterans benefits.

d. Discharge from Draft

A person who was ordered to report to an induction station, but was not actually inducted into military service.

e. Person Found Guilty of a Capital Crime

Under 38 U.S.C. § 2411, interment or memorialization in a VA national cemetery or in Arlington National Cemetery is prohibited if a person is convicted of a Federal or State capital crime, for which a sentence of imprisonment for life or the death penalty may be imposed and the conviction is final. Federal officials may not inter in veterans cemeteries persons who are shown by clear and convincing evidence to have committed a Federal or State capital crime but were unavailable for trial due to death or flight to avoid prosecution. Federally funded State veterans cemeteries must also adhere to this law. This prohibition is also extended to furnishing a Presidential Memorial Certificate, a burial flag, and a headstone or marker.

f. Subversive Activities

Any person convicted of subversive activities after September 1, 1959, shall have no right to burial in a national cemetery from and after the date of commission of such offense, based on periods of active military service commencing before the date of the commission of such offense, nor shall another person be entitled to burial on account of such an individual. Eligibility will be reinstated if the President of the United States grants a pardon.

g. Active or Inactive Duty for Training

A person whose only service is active duty for training or inactive duty training in the National Guard or Reserve Component, unless the individual meets the eligibility criteria listed in Section III.1.b. of this information sheet.

h. Other Groups

Members of groups whose service has been determined by the Secretary of the Air Force under the provisions of Public Law 95-202 as not warranting entitlement to benefits administered by the Secretary of Veterans Affairs.

Prosectuors this morning told jurors in Katie Nadal's injury to a child trial that she completely cut off her 5-week-old son's penis and testicles, leaving a perfectly square wound.

Defense attorneys countered that they'll present expert testimony that the wound could have been caused by a dachshund, as Nadal told investigators.

Assistant District Attorney Denise Oncken told jurors that Nadal injected cocaine the day before, had an argument with her husband that day and then assaulted the child the next morning.

Oncken told jurors the couple argued over whether the baby should be circumcised, with Katie Nadal arguing in favor.

MEXICO CITY - President Barack Obama says he prefers to focus on enforcing existing laws to keep assault weapons out of Mexico, rather than trying to renew a U.S. ban on the weapons.

Obama says he still believes such a ban made sense. The most recent one expired in 1994.

But he says he'd rather enforce laws on the books that make it illegal to send assault weapons across the Mexican border.

Guns flowing into Mexico from the U.S. have been fingered in a rise in killings by Mexican drug cartels.

As a presidential candidate, Obama promised to push to reinstate the ban. He now says doing so would be politically difficult.

Obama commented in Mexico City at a news conference with President Felipe Calderon after their meeting.

WEDNESDAY, Oct. 8 (HealthDay News) -- European researchers say they've figured out how to coax sperm-producing testicular cells into embryonic-like stem cells.

The findings are the latest in a flurry of published research that seeks to duplicate embryonic stem cell behavior and biology while sidestepping the political and ethical obstacles associated with their use.

"The ability to make a pluripotent stem cell from an individual without the ethical and immunological problems associated with human embryonic stem cells is a big deal," said Peter J. Donovan,, a stem cell expert at the University of California, Irvine.

The new research was published online Oct. 8 in the journal Nature.

Thomas Skutella of the University of Tubingen in Germany and his colleagues used testicular tissue from 22 men to create what they call "germline stem cells." Essentially, they collected these tissues, isolated the cells that give rise to sperm cells, and then cultured them in growth media containing factors that support the development of human embryonic stem cells. Within a few weeks, the cells took on many of the genetic and growth characteristics of embryonic stem cells.

At the genetic level, for instance, the new cells were more like embryonic stem cells than sperm cells. When injected into immune-compromised mice, they produced teratomas, a tumor that contains many different kinds of cells. When grown in culture dishes, the new cells could be directed to differentiate into muscle, bone, neurons, and pancreatic tissues, the study authors said.

"My summary is, it is a nice paper, they made big progress in getting to a pluripotent cell, and they show pluripotency with a teratoma experiment," said Dr. Gerd Hasenfuss of the University of Gottingen, Germany, who has published papers on converting mouse sperm cells into stem cells.

"But I think we are not completely there where we want to be," he added, "namely at pluripotency absolutely comparable to that of embryonic stem cells." In particular, he noted that the study authors failed to show creation of cells called cardiomyocytes, which cause heart muscle to beat.

The new study is the latest in a string of related work on creating embryonic-like stem cells. Researchers and clinicians alike are excited by the potential of embryonic stem cells because they are "pluripotent," meaning they can create any cell type in the body. Most adult cells, in contrast, if they can divide at all, can only create cells of the same type -- that is, a dividing skin cell can only create another skin cell. So, embryonic stem cells could be used to create new tissues for transplantation, say, or to study how genetic mutations cause development to go awry.

The problem, of course, is that to obtain embryonic stem cells, an embryo must be destroyed -- a process fraught with ethical and political difficulty. Recently, researchers sidestepped this problem by turning back the clock on adult mouse and human "somatic" cells, such as skin cells, to make them behave as if they were embryonic. The trick is to introduce four genes into the cell you want to reprogram, creating so-called induced pluripotent stem (iPS) cells.

Originally, iPS cells were created using modified retroviruses or lentiviruses -- the same type of virus that causes AIDS, for instance. But this type of virus inserts its viral genetic material into the host cell's chromosomes, causing mutations, which effectively made the process a non-starter for clinical work.

Two weeks ago, a team at Harvard described a way to accomplish the same thing using viruses that skip this genetic integration step, theoretically making the process safer.

Now Skutella and his team have demonstrated similar results while avoiding genetic manipulations altogether; instead, the reprogramming is induced by changing the cells' growth conditions.

What these authors accomplished, said Hasenfuss, was "to get a pluripotent cell out of the spermatogonial [sperm] stem cells without the need of gene transfer requiring viruses."

Skutella and his colleagues aren't the first to reprogram testicular cells; others have already done so in mice. But his team was the first to successfully do so in humans, said Dirk de Rooij, emeritus professor of endocrinology at Utrecht University in the Netherlands, who recently wrote a review on reprogramming mouse spermatogonial stem cells.
De Rooij called the new study "a breakthrough."

"In comparison to the mouse studies that have been done, there is a big leap forward in efficiency with which these people get these germline stem cells," he said.

But besides the obvious fact that women can't benefit from this development, Donovan, who called the study "an exciting piece of work," raised one additional question that may limit the technique's adoption: "I suspect people would be much more willing to give up a piece of skin to make an iPS cell than to have a testicular biopsy to give rise to an adult germline stem cell," he said.


I wonder if research will be allowed to continue on a project that benefits men only.

FDR was elected three years later when voters denied Hoover a second term. The Democratic challenger appealed to the "forgotten man" by promising a "new deal" to solve the Depression era.


AFAIK, the first Presidential address on tv was Eisenhower in '51.

A 55-year-old Houston man was sentenced to nine years in prison Friday for possessing more than 2,000 child pornography photos and movies.

Authorities said Victor Saavedra admitted in September 2006 that he possessed a computer containing almost 2,000 images and 270 movies of child pornography. All of the movies and most of the images were sent via the Internet by underage girls at Saavedra's request, prosecutors said.
Saavedra pleaded guilty in May and was sentenced today by U.S. District Court Judge Ewing Werlein Jr..

After his release from prison, Saavedra will remain under supervised release and be required to register as a sex offender for the rest of his life.

The case was brought as part of Project Safe Childhood, a nationwide initiative in which federal and state agencies work together on online exploitation and abuse cases.

Agencies investigating the case were the Texas Attorney General's Office Internet Crimes Against Children Task Force, the Houston Police Department and the Royal Canadian Mounted Police, with help from the National Center for Missing and Exploited Children.


I always wondered how guys like this seem to easily amass this stuff, yet LE has trouble taking down the purveyors.
It's because the victims themselves are putting it out.
Teens are punished for every other crime, so why not this?

So I predict 2 things will happen:

1. The left and American feminists will do every rotten thing in the book to either demonize this woman or find a flaw with her including going after her daughter.
2. The left will claim in some way their programs, affirmative action etc is what really got Palin where she is and she is just too programmed or misguided to acknowledge it.


The beauty of it is that Palin began taking "ownership" of feminism with her "18 million cracks" statement. I'm pretty sure she'll continue to do so by applauding the sisters that got her here, etc. This makes option number 2 very difficult.
The Democrat's best reaction would be for Hillary to utterly disown her. So will Hillary the do right thing for the party and go after Palin with a vengeance, possibly ruining her own chances to run again for at least 8 years? Or will she keep mum and look toward 2012?  We'll see.
