Lindsay Lohan Sentenced to 90 Days in Jail, 90 Days of Rehab

Bawling and broken, Lindsay Lohan learned today that she's going back to jail.

Quote
Lohan may only end up serving a few weeks of her 90 day jail sentence -- Whitmore noted that "female, non-violent prisoners will do about 25-percent of their sentence" because L.A. jails suffer from "an overcrowding sitution."

After the hearing, Lisa Bloom, the attorney for Lohan's estranged father, Michael, said that if the starlet had followed their advice and gone to rehab, she might not be facing jail time now.

Revel said she found the starlet's apology insincere, comparing it to "somebody who cheats and thinks it isn't cheating if she doesn't get caught."

Isn't that what goes on in Family Court all the time?

The only difference I see is that women who "cheat and don't expect to get caught" are usually rewarded in family court.

Seems she had a message for the judge painted on her nails. Some are thinking it means she risks more time since the judge also gave her 90 days instead of the 30 the prosecution requested.

Interesting find Q.  I did a little searching and - - - very interesting...

There are a couple of nice clear photos in the article below, but I don't see the fingernail art in the Youtube video.  I wonder if the photos were Photoshopped?  At 1:45 in the video you can see Lohan's hands and fingers.  At 1:56 in the video a little bit of blue does show on her fingernails, but it's very faint in the video.  There is something there.

As most people are aware, most still photography, will produce better details than most videos so if there were still photographers in the courtroom, I suspect it's there photos leading to this discussion.  It's interesting the judge allowed the press in the courtroom  One can only wonder what else we are missing that goes on in courtrooms.  Hmm.

Just before being sentenced Tuesday to 90 days in jail for violating the terms of her probation, Lindsay Lohan pleaded with the judge, saying, "I'm not taking this as a joke, it's my life and career. I don't want you to think I don't respect you and your terms."

But the perennially troubled star's hand -- actually her fingernail -- told a different story. Written neatly on the middle finger of her left hand was a crass message, one that doesn't exactly show much "respect" for the court or the judge.

No photoshop on that pic! Several different news sources checked various photos from different agencies that were reporting and they all had the same thing.

Lohan says fingernail expletive was a joke, not a jab at judge

July 7, 2010 |  9:37 pm

Actress Lindsay Lohan wrote Wednesday that an expletive visible on her fingernail during the court hearing where she got 90 days in jail was a joke unrelated to the Beverly Hills case.

Lohan wrote on her Twitter account that the vulgarity on her middle fingernail "had nothing to do w/court. It's an airbrush design from a stencil xx."

As the actress told Judge Marsha N. Revel on Tuesday that she was taking the probation violation seriously, the expletive was captured by the courtroom photographer. It raised questions about the message she was sending.

In a series of Twitter messages, Lohan also wrote about "cruel and inhuman punishment," quoting from the United Nations Declaration on Human Rights. She also linked to a Newsweek story about the stoning of an Iranian woman.

The fingernail was visible as Lohan wiped tears from her eyes during a last-ditch attempt to avoid jail after the judge decided the actress had violated her probation by failing to attend weekly alcohol education classes. Lohan's probation stems from a conviction for driving under the influence following two DUI incidents in 2007 during which she also tested positive for cocaine.

Lohan must surrender July 20.

Yep, it was all over the Los Angeles evening news too.  Where or where would a young girl get an attitude like that?  :dontknow:

She'll serve a few weeks maximum in prison, but that doesn't matter to her.  What matters to her is the life sentence of being Lindsay Lohan.

"Scared" Lindsay Lohan plans to appeal jail term

LOS ANGELES (Reuters) - Lindsay Lohan is "scared to death" about going to jail, and is planning to appeal her 90-day sentence with a new lawyer, her mother Dina Lohan said in an interview.

"She's a fighter, and until the final result -- we're not giving up," Dina Lohan told celebrity news television show Entertainment Tonight in an interview to be broadcast on Friday.

"I think it's time we get another attorney just to see it from another light and do damage control," she added, saying her daughter hoped to file an appeal.

The "Mean Girls" actress is due to start her three-month jail term on July 20. She was ordered to jail by a Beverly Hills judge who ruled on Tuesday that Lohan, 24, had violated her probation for a 2007 drunk driving and cocaine possession case because she had failed to attend weekly alcohol education classes imposed by the court.

Lohan's lawyer abruptly quit on Thursday, hours after issuing a statement calling the sentence "harsh and unfair" but stating that Lohan was prepared to serve her jail time and comply with the court's orders."

Lawyer Shawn Chapman Holley did not give a reason for leaving, but Dina Lohan suggested Lohan's team was unhappy with Holley's handling of the case.

"I feel like Shawn, Lindsay's attorney, should have stood up (in court on Tuesday) and said, 'Listen, I didn't know you were going to have witnesses.' We would have had ten witnesses. We didn't get a shot. We didn't get a shot at fairness," Dina Lohan said.

Lohan was stunned by the sentence, breaking into sobs in court in a hearing that was streamed live on celebrity news site TMZ.com. TV industry paper Broadcasting & Cable said that 2.3 million people watched Tuesday's hearing on TMZ.com -- a bigger audience than some TV shows command.

"It's very difficult, we're not sleeping well, we're not functioning. We cry a lot and we hug a lot. She's petrified, we all are. We're angry. We're disappointed in the system," Dina Lohan said. "Lindsay's scared to death."

Asked if her daughter could survive jail, she said; "You know, she's strong, but until someone faces something as devastating as that...we're going to have to see...God willing it won't happen."

Dina Lohan said she and Lindsay were spending hours researching case law.

Lindsay Lohan sent out a stream of messages on her Twitter account earlier this week citing articles in the United Nations Human Rights declaration regarding torture, cruel, inhuman and degrading punishments.

Lohan rose to fame as a child actress in "The Parent Trap" and later movies like "Freaky Friday" established her as one of Hollywood's most promising young actresses.

But her career has spiraled downward since 2007, when she made three trips to rehab and spent 84 minutes in jail on the drunk driving offense.

Ah. The 'system' worked as it supposed to... and they guilty is disappointed.

I love the line about the ten witnesses; does Mommy Dearest mean that they would have purchased witness statements to the effect that Lindsey was present at the nine weekly alcohol education classes she missed?

She was probably late to the classes and those court ordered rehabs count a tardy as an absence. Odly enough if she goes to jail and does the whole 90 plus a REAL 90 day inpatient drug treatment that she can't check herself out of it will probably save her life and career. As it stands now she will be doing hardcore porn in a few years and she will die of an overdose or alcohol poisioning a few years after that. At least thats my prediction. If she gets clean she has talent and can be a star again.
You may sleep soundly at night because rough men stand ready to visit violence upon those who seek to harm you.

Okay, who had the over/under on this?

serveral board members called this pretty much 100% accurate
I would like to say again,in a big county like los angeles, serving a short time on these county sentences isn't uncommon. bigger counties generally give "3 to one" or "4 to one" on misdemeanor sentences. for instance, if you were sentenced to 90 days in dallas county, 20 to 30 days would be par for the course
