Colorado woman accused of stabbing husband with scissors

COLORADO SPRINGS, Colo.--A 61-year-old woman has been arrested after her husband was stabbed in the back and stomach with a pair of scissors.

Colorado Springs police say they were called to a home on Sunday after a woman identified as Jerolyn Hanenberg called 911 and reported that she had just stabbed her husband.

The man was taken to a hospital with serious injuries. The woman is facing charges of attempted murder.

Such a lovely woman.  Too bad she's already taken.  :rolle:

Yeah, well, she's no prize.

Yet if she called 911, the attempted murder charge is an overcharge. Her calling for help negates the requisite mens rea of attempted murder, i.e. that she intended his death. IMO the proper charge would have been aggravated battery (a felony). If she has a competent lawyer, that is what she'll be convicted of (or pleads guilty to).
